General Terms and Conditions for Participation in the International Starnberg Management Days
1. Scope
For contracts regarding the participation in the Starnberg Management Days of Seidenschwarz & Comp. GmbH the conditions in the registration form as well as the following general terms of contract apply. A participation contract for the Starnberg Management Days will only be concluded after Seidenschwarz & Comp. GmbH has confirmed the participation to the participant in writing. Registration for the Starnberg Management Days is usually done via e-mail, fax or internet. Verbal agreements are only valid if confirmed in writing by Seidenschwarz & Comp. GmbH.
2. Performance
The participation fee is per person and event date plus statutory VAT. The Seidenschwarz & Comp. GmbH reserves the right to change the course of the event at short notice compared to the information in the event program or on the Internet, to replace individual lectures or to omit them if the circumstances make this necessary. Such changes do not create a right to a refund or reimbursement of other expenses. There is no claim that a lecture will be held by an announced speaker. Seidenschwarz & Comp. GmbH reserves the right to cancel or reschedule the Starnberg Management Days in the event of absence or illness of the management and/or several speakers, disruption to the event location or for reasons of force majeure (pandemic, epidemic, natural phenomena, epidemics and legal acts of the government). In the event of cancellation, Seidenschwarz & Comp. GmbH will refund the already paid participation fee. In addition, there are no further claims, in particular no claims for reimbursement of travel and accommodation costs as well as loss of work and sales. This applies irrespective of officially regulated variable numbers of participants, official customer regulations, other official regulations as well as any legal acts.
3. Rejection of an application
Seidenschwarz & Comp. GmbH reserves the right to refuse registration for the Starnberg Management Days in justified cases.
4. Use Rights
Lectures and event documents are protected by copyright law. Photographing, filming and recording on storage media of any kind is not permitted at the Starnberg Management Days. Event documents, which are handed out to each participant in the course of the Starnberg Management Days, may not be duplicated, distributed, made publicly available or used or changed in any other way without the written permission of Seidenschwarz & Comp. GmbH as well as the speakers. Rights of use are only transferred by explicit written permission.
5. Maturity and Payment
The participation fee is due within 14 days after receipt of the invoice. In case of delayed payment Seidenschwarz & Comp. GmbH is entitled to claim the respective legally valid interest on arrears. Payment shall be made on invoice, payments in cash, by check or credit card are excluded. In case of subsequent change of invoice address Seidenschwarz & Comp. GmbH is entitled to charge a service fee in the amount of 20,- € plus statutory VAT.
6. Cancellation of Registrations by Participants
Cancellations must be made in writing in all cases. If a registration is cancelled up to 30 days before the start of the event, administrative fees of 40 percent of the event fee will be charged. 60 percent of the participation fee will be refunded. In the event of a later cancellation, the entire participation fee will be charged. There is no entitlement to reimbursement of participation fees in the event of illness.
The substitution of a participant by another person is possible, but requires a written confirmation by Seidenschwarz & Comp. GmbH.
7. Liability
With regard to liability, the statutory provisions shall apply. In particular, it is pointed out that Seidenschwarz & Comp. GmbH, its legal representatives as well as its vicarious agents are only liable in case of demonstrable gross negligence or intentional behavior. Seidenschwarz & Comp. GmbH is not liable for damages on the way to and from the Starnberg Management Days. Seidenschwarz & Comp. GmbH does not assume any liability for the topicality, correctness, completeness and quality of the lectures as well as the information material provided within the scope of the Starnberg Management Days. Seidenschwarz & Comp. GmbH does not assume any liability for damages and consequential damages of material and immaterial nature resulting from the use or non-use of possible incorrect and/or incomplete contents of the lectures and/or event documents.
8. Privacy
Personal data will be electronically stored and processed by Seidenschwarz & Comp. GmbH exclusively in the context of the event and contract processing. By registering for the Starnberg Management Days, the participant agrees to the collection, storage and processing of his/her personal data. We explicitly point out that photos and videos will be taken during the event, which will be used primarily for the publication of the review of the international Starnberg Management Days on our website and whose rights of use are held by Seidenschwarz & Comp. GmbH. If you do not agree with this, please provide a written statement to this effect at the event.
9. Jurisdiction
German law applies to the exclusion of the UN Sales Convention. The place of jurisdiction is Munich.
Right of withdrawal
10. Right of withdrawal
The participant, if he/she is a consumer, has the right to cancel in writing (fax, e-mail, letter) within 14 days without giving reasons. The cancellation period begins on the day of the written confirmation (fax, e-mail, letter) of the registration for the Starnberg Management Days.
11. Final Provisions
Should individual clauses of these General Terms and Conditions for the Starnberg Management Days be invalid in whole or in part, this shall not affect the validity of the remaining contractual clauses. The relevant statutory provisions shall take the place of legally invalid clauses.
